The federal government's Malaysia solution has hit a snag, with today's first deportation of asylum seekers delayed.

A last minute decision by the High Court has been the transfer put on hold, pending a hearing in Canberra this afternoon.

It followed an application from leading refugee lawyer David Manne.

He's asked the court to rule the government doesn't have the power to remove asylum seekers under its controversial swap deal with Malaysia.
